Right of withdrawel

(1) Information on the right of cancellation

As a consumer, you have the right to cancel the contract in accordance with the statutory provisions. A consumer within the meaning of § 13 BGB is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity. The following cancellation policy informs you about the details of the right of cancellation.

CANCELLATION POLICY / RIGHT OF CANCELLATION

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of cancellation, you must inform us:

Kay Knipschild e.K.
Almstadtstr. 35
10119 Berlin

Telephone number: +49-30-39878884
E-mail: onlineshop@burgundschild.com

VAT ID No.: DE28 65 78 094

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

CONSEQUENCES OF CANCELLATION

If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract:

Burg & Schild
Rosa-Luxemburg-Str. 3
10178 Berlin

or to hand it over. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

International Returns from Third Countries (Non-EU Countries)

Goods returned to us from a third country (i.e. a country outside the European Union) may, under certain conditions, be treated as so-called “returned goods” and can be exempt from import duties if correctly declared. This requires that the goods were originally shipped from the EU and that the return shipment is clearly and properly identified as such.

Please note that we do not assume any responsibility for customs duties, import VAT, or other charges that may arise due to incorrect, incomplete, or inaccurate customs declarations. Shipments sent carriage unpaid or subject to outstanding customs charges will not be accepted. Any costs incurred may be deducted from your refund in accordance with Sections 6 and 7 below.

To help ensure a smooth return process, we ask that you observe the following information. These notes are intended as guidance only and do not constitute a complete or legally binding instruction. You are advised to consult the relevant authorities or your shipping provider regarding the specific requirements applicable in your country.

1. Preparing the Return

The goods must be returned in their original condition and, where possible, in the original packaging to prevent transport damage. If the goods are returned without the original packaging, a deduction for any resulting loss in value may apply.

2. Marking the Shipment as “Returned Goods”

To avoid delays or additional charges during customs clearance, the shipment must be clearly declared as returned goods.
Please mark the outside of the package clearly with the following wording:
“Returned Goods – Relief Claimed. EU Origin”

3. Completing the Customs Declaration

The customs declaration form CN23 must be completed in full and accurately for the return shipment.

4. Required Documentation

The completed CN23 customs declaration and the original invoice (or a copy thereof) must be placed in a clearly visible document pouch on the outside of the parcel.
If available, an INF3 information sheet may be enclosed as additional proof of the EU origin of the goods.

5. Shipping the Return

The shipping label must be clearly legible and must not contain any contradictory information.
Please use a shipping service provider experienced in international returns and customs clearance, and inform yourself in advance about the applicable shipping conditions and customs requirements.
If you arrange postage yourself, we recommend choosing a shipping method with tracking.

6. Returns, Deadlines and Costs

You are responsible for the direct costs of returning the goods.
If the goods are not declared in accordance with these instructions, customs duties or taxes may be incurred, which we may deduct from your refund.
The return shipment must be dispatched no later than 14 days after you have submitted your notice of withdrawal.
Once the returned goods have been received, we will process your return as promptly as possible. Please retain your proof of shipment and tracking number until we have confirmed receipt of the return.

7. Liability

We do not accept liability for delays or additional costs if a shipment is held by customs due to incomplete or incorrect declarations.
If a return shipment is not properly declared in accordance with Section 2 and/or does not include the required documentation in accordance with Sections 3 and 4, and import duties are incurred as a result, responsibility lies with the sender.
